A

Questions (LTO MEMORANDUM CIRCULAR NO. RTL-MC-02415)

It amends LTO Memorandum Circular No. RTL-MC-02413 dated 18 December 2002, specifically regarding the rules on mandatory vehicle emission testing.

They must be done at the authorized Private Emission Testing Centers (PETCs).

MVIS shall continue to conduct emission tests for the same purposes—renewal of registration and redemption of confiscated vehicle/plate—but only to cover public utility vehicles.

MVIS has exclusive authority to conduct emission testing to vehicles submitted for adjudication, to the exclusion of PETCs.

In proper cases, only emission tests conducted at properly authorized PETCs, after payment of the corresponding fees and charges to DOTC, shall be valid.

No. Paragraph 4 requires that the PETC must be properly authorized; otherwise, the test is not covered by the validity rule.

Payment of the corresponding fees and charges to DOTC.

LTO cannot accept any application for renewal of registration without a valid CEC in the form prescribed, issued by a properly authorized PETC when the emission test is conducted by the PETC.

A valid CEC in the form prescribed in paragraph 3, issued by the properly authorized PETC.

LTO shall not accept the renewal application.

It also covers redemption of vehicle or vehicle plate confiscated due to roadside apprehension, whichever is applicable.

MVIS tests public utility vehicles only; PETCs handle the emission tests for the enumerated purposes for other vehicles.

It means either the redemption of the vehicle itself or the redemption of the license plate applies depending on what was confiscated in the roadside apprehension.

MVIS has exclusive authority; PETCs cannot conduct such testing for adjudication-submitted vehicles.

It takes effect immediately (upon adoption on 26 December 2002). Practically, compliance with the amended rules would apply without delay from that date.
