PD 1031 amends Presidential Decree No. 991 by declaring that the provisions of Presidential Decree No. 229 (on voting and canvass in barangays/citizens’ assemblies) shall apply to the National Referendum-Plebiscite of October 1976, and for related purposes.
PD 1031 amends PD 991 by making PD 229’s barangay voting and canvass provisions applicable to the October 1976 national referendum-plebiscite.
The Commission on Elections (COMELEC) has exclusive supervision and control.
PD 229’s provisions govern the conduct of the referendum-plebiscite, including prohibited acts, penalties, prosecution of offenses, and jurisdiction of courts related to the referendum.
Prohibited acts; imposition of penalties; prosecution of offenses; and jurisdiction of courts in connection with the referendum-plebiscite.
The questions must be translated into as many major dialects as possible.
They must be printed in leaflet or poster form in sufficient number using cheap but appropriate material.
At least fourteen (14) days before referendum-plebiscite day.
Dissemination must be made as widely as possible to all barangays where the dialect used in the translation is spoken.
It means that other provisions (from prior decrees related to referenda) apply only as additional rules to fill gaps, and only if not inconsistent with PD 1031.
Presidential decrees related to the referenda of July 1973 and February 1975.
It repeals Sections 4, 8, 9, 10, 13, 14, and 15 of PD 991 and repeals all other provisions inconsistent with PD 1031.
It renumbers Sections 5, 6, 7, 11, 12, 16, 17, 18, 19, and 20 of PD 991 as Sections 4, 5, 6, 7, 8, 9, 10, 11, 12, and 13, respectively.
Eight Million Pesos (P8,000,000.00) is appropriated to carry out the provisions of the decree under the exclusive authority of the COMELEC.
Out of any funds in the National Treasury not otherwise appropriated.
It takes effect immediately.
