DENR Administrative Order No. 2000-23 amends regulations for the management and development of forest lands used for grazing, establishing a structured payment schedule for government shares, penalties for late payments, and incentives for compliance, while ensuring the reversion of expired areas to forest production.

Payment of the government share for the previous year should be remitted on the first month of the succeeding year to the National Treasury.

Penalties for late remittance shall be imposed at 1% of the annual government share per month.

Failure to pay the government share for two consecutive years shall be a ground for automatic cancellation of the Forest Land Grazing Management Agreement (FLGMA).

Cancelled and expired pasture leased areas which have not been renewed and have no new applicants shall automatically revert to forest tree production including the production of non-wood forest products.

The user’s fee schedule is: Year 1 - P200.00/ha/yr, Year 2 - P275.00/ha/yr, Year 3 - P350.00/ha/yr, Year 4 - P425.00/ha/yr, Year 5 - P500.00/ha/yr.

Non-grazeable areas must be reforested at a rate of 10% of the area or at least 25% reforested at the expiration date as a primary condition for renewal of the FLGMA.

An automatic adjustment of the user’s fee is made based on the assessment of the productivity of the grazing land by the assessment team.

A new basic user’s fee system will be determined by the DENR, with an increase of not less than 10% of the last rental.

The basic user’s fee shall apply if the computed economic rent falls below it.

An incentive scheme involving a reduction of the government share up to 80% is provided, depending on the agreement holder’s compliance with specified incentives.
