The GSIS 'No Gift Policy' is based on Section 29 of the Governance Commission for GOCCs (GCG) Memorandum Circular No. 2012-07, which mandates all Governing Boards of GOCCs to adopt a 'No Gift Policy' and ensure its strict implementation within the organization.
A 'Gift' is defined as a thing or a right to dispose of gratuitously, or any act of liberality in favor of another who accepts it, including simulated sales or ostensibly onerous dispositions. It excludes unsolicited gifts of nominal or insignificant value not given in anticipation of or in exchange for a favor from a public official or employee.
The policy applies to all GSIS officials and employees regardless of their status of appointment.
They are prohibited from directly or indirectly soliciting gifts, favors, or benefits from stakeholders, and from directly or indirectly soliciting, accepting, or receiving any gift, favor, or benefit that may influence or be perceived to influence their official functions.
Exceptions include token gifts, plaques, awards, certificates, souvenir items, gifts related to official ceremonies, gifts given by GSIS during celebrations, institutional gifts to GSIS, approved scholarships, travels, trainings, and gifts subject to approval by the Chairman of the Board of Trustees.
The Gift Register serves to monitor and record gifts given to and received by GSIS officials and employees to ensure transparency.
The Gift Register must record the date of receipt, description, estimated value, recipient's name, giver's name and position, and the action taken on the gift.
Heads of Offices or Units are responsible for maintaining the Gift Register and submitting annual reports to the Compliance Officer, who then submits a consolidated report to the Board of Trustees.
Violations are referred to the Prosecution and Quasi-Judicial Cases Department for investigation and disciplinary action in accordance with RA 6713, RA 3019, the Revised Rules on Administrative Cases in the Civil Service, and other relevant laws.
The Compliance Officer is the executive designated by the Board of Trustees to ensure GSIS's compliance with RA 10149, GCG issuances, and the 'No Gift Policy.' The officer monitors reports on gifts received and ensures proper implementation of the policy.
