The regulation is titled "Air Cargo Security for Passenger Commercial Aircraft" as established by the OTS Transportation Security Regulation No. 013-2010.
The regulation is based on Section 10 of the National Civil Aviation Security Program (NCASP) in relation to Annex 17 of the International Civil Aviation Organization (ICAO).
Air Cargo includes normal freight, consolidation, transshipments, unaccompanied courier items, postal mail, diplomatic mail, and unaccompanied baggage shipped as freight on a passenger commercial aircraft, excluding mail, stores, and accompanied or mishandled baggage.
The Office for Transportation Security (OTS) is designated as the single authority mandated to ensure the implementation of Annex 17 to the ICAO and NCASP.
OTS accepts applications for certification as regulated agents, conducts surveys and inspections, approves and certifies regulated agents, and ensures compliance with security standards and requirements for a two-year certification period.
Such misrepresentation or fraud is ground for disapproval or cancellation of the certification, and the person or entity shall be perpetually disqualified or banned from doing business at the airport.
A regulated agent must give prior notice to the airline or cargo operator, identify personnel and vehicles involved, execute an oath of undertaking certifying cargo security, and ensure the cargo undergoes required security controls and screening before acceptance.
Sealed diplomatic mails consistent with the Vienna Convention shall not be screened provided they are properly identified and accompanied by a certificate signed by the designated official of the sending State.
Authorized screening procedures include hand search, conventional x-ray machines, explosives detection systems, metal detection, explosive trace and vapor detection, and the use of OTS-accredited explosive detection dogs (K-9).
PNP-AVSEGROUP supervises and monitors security controls in acceptance, handling, and loading of cargo, demands security undertakings from airline operators and shippers, deploys trained personnel to monitor cargo security, and supervises security screening at airports.
