The legal basis is Article XIII, Section 18(2) of the 1987 Constitution of the Philippines, which grants the CHR the power to adopt its operational guidelines and rules of procedure.
Applicants from the military sector, police sector, Philippine Coast Guard, other law enforcement officers and personnel including the National Bureau of Investigation, Philippine Center for Transnational Crimes, Bureau of Corrections, Bureau of Jail Management and Penology, Bureau of Fire Protection; officers and employees of other government agencies, and private sector professionals for purposes such as employment, training, schooling, or scholarship.
Applicants must fully accomplish the official application form under oath and attach records of government employment service, indicating full name, residential and office/business address, identification such as serial number for military or badge number for law enforcement, social security identification or professional license number for private sector professionals, and information on completed human rights education/training courses.
Applications should be filed at the CHR Regional Office where the applicant's current official work station is located or at the General Records and Archives Division (GRAD), Office of the Commission Secretary, CHR Central Office.
Initial records check by the Regional Records Officer, supervised by the Regional Director, is conducted to determine pending cases at the regional level. The application and regional certification are then forwarded to the Legal and Investigation Office at the CHR Central Office for general records check/verification and databank retrieval before final processing.
Yes, a clearance fee of One Hundred Pesos (P100.00) must be paid, subject to existing laws and rules. Additionally, a documentary stamp worth Fifteen Pesos (P15.00) must be affixed to the Clearance or Certification document.
The Chairperson or Officer-In-Charge of the Commission for applicants assigned to the main headquarters of the AFP and PNP. For applicants assigned outside these headquarters, the Commissioner-in-Charge or Assisting Commissioner-in-Charge of the respective region has final approval authority.
The CHR Clearance or Certification is valid for six (6) months from the date of issuance and only for the stated purpose. Renewal is possible for the same purpose. A new clearance is required if the applicant applies for a different purpose, undergoing the same application and processing requirements.
