Questions (EXECUTIVE ORDER NO. 816)

EO No. 816 cites the President’s powers under the Constitution and the authority vested by Presidential Decree No. 1416 as amended.

To pursue an integrated and more efficient approach to agrarian reform by transferring the ACA’s financial and extension-related functions to a single institutional mechanism—specifically the Land Bank of the Philippines.

The Agricultural Credit Administration (ACA) is abolished, and its functions are transferred to the Land Bank of the Philippines (Land Bank).

Its functions, together with its assets and liabilities, applicable appropriations, records, equipment, and property are transferred to the Land Bank.

The valuation of the net assets is determined by the Land Bank jointly with the Office of Budget and Management (OBM) and the Commission on Audit (COA).

Under Section 2, all valid existing contracts continue to be honored by the Land Bank.

The Land Bank may appoint qualified personnel of the ACA to appropriate positions in the Bank; those not appointed are deemed laid off.

They are entitled to all benefits and gratuities provided for under existing laws.

Section 4 provides that present incumbents continue to exercise their present functions, duties, and responsibilities pending the issuance of appropriate implementing orders, except as determined by the Land Bank.

Section 5 repeals or modifies any laws, decrees, orders, proclamations, rules, regulations, or parts thereof that are inconsistent with EO No. 816.

Under Section 6, such portion shall not nullify the other provisions, provided the remaining portions can stand and be given effect to accomplish EO 816’s objectives.

It takes effect immediately, as stated in Section 7.

The Land Bank of the Philippines is specifically required to honor all valid existing contracts of the ACA under Section 2.
