Under the lease agreement attributed to Regidor, rent was payable in advance within the first five days of each month. Accordingly, the rent for May 1903 was due before May 5. On May 13, Regidor assigned his right to collect the rent for that month, amounting to $325, to Waite, the plaintiff. The defendants were notified of this assignment on May 16 and were subsequently required to make payment for the assigned rent, which they refused to pay.

Disputed Rent Allocation

After the court’s decision on May 21, the defendants were informed to direct rent payments to the Obras Pias rather than to Regidor. The defendants paid the portion of the rent corresponding to their lease for the period from May 21 to the end of the month but retained a balance of $216.66, which was not paid to either Waite or the Obras Pias.
