Case Summary (G.R. No. L-3908)

Initial Complaint and Claims

On March 6, 1906, the plaintiffs, in their capacity as executors, submitted a complaint requesting the court to order the defendant to return certain real properties and personal items, including a drag net and a carriage, which they claimed belonged to the deceased Margarita Sivila. The plaintiffs demanded not only the return of the property but also the profits generated from the property amounting to P75,000 since 1890, in addition to claiming P15,000 for expenses, losses, and damages, plus other damages and court costs.

Defendant's Objection and Jurisdictional Challenge

On April 21, 1906, the defendant filed a demurrer, contending that the Court of First Instance of Ilocos Norte lacked jurisdiction over the case. The court emphasized that jurisdiction should lie where the principal property and the parties were situated, overriding the executors' claim related to the estate being in Ilocos Norte.

Appeal and Final Judgment

Following the decision to sustain the demurrer, the plaintiffs lodged an exception to the ruling and subsequently filed a bill of exceptions on January 26, 1907. However, the court deemed this appeal to be prematurely filed, clarifying that a bill of exceptions could only be entertained after a final judgment as stipulated in sections 101 and
