Case Summary (G.R. No. L-5840)

Proceedings and Initial Verdict

Tolentino was charged with treason in the Court of First Instance of Davao. Following the trial, the court found him guilty. The penalty imposed was reclusion temporal for a duration of 12 years and 1 day, along with a fine of P10,000.00, and he was ordered to pay the costs of the proceedings without subsidiary imprisonment should he be unable to pay the fine.

Testimonies of the Prosecution

Witnesses Miguela Baring and Jesus Rodriguez testified against Tolentino, stating that on November 19, 1942, he was seen accompanying approximately forty Japanese soldiers to the residence of Adriano Enero. Furthermore, he sought to discredit the prosecution witnesses by arguing that they bore personal grudges against him; particularly, he indicated that Rodriguez had been caught stealing and that he had refused to provide food to Manuela Enero due to his own family's needs.

Court's Analysis and Ruling

The trial court rejected Tolentino's defense, concluding that there was no credible motive for the prosecution witnesses to fabricate their testimony against him. Even considering Tolentino’s claims of assisting guerrillas, the court emphasized that this did not absolve him of the criminal responsibility for his role in facilitating the arrests of fellow Filipinos by Japanese forces. Consequently, the court affirmed the judgment of convict
