Factual Background

These stipulations included that, at the time relevant to the arrest, procedural aspects of warrantless apprehension were contested in the proceedings but later treated as waived for purposes of the conviction.
The victim, AAA276117, testified that Kim was a foreigner and a recurring visitor to their home. She described Kim as initially generous, giving money during his visits. Around November 2017, she learned that Kim had romantic intentions toward her. She then began to feel uncomfortable after Kim confessed his feelings to her. The incidents escalated in frequency. Kim began visiting more often, sometimes staying overnight. During drinking sessions, he would insist that she sit beside him and would then invite her into a room where he inappropriately touched her private parts. When she resisted, Kim left angrily, and she testified that her parents scolded her, implying that Kim would stop giving money if she refused. Kim then offered increasingly larger sums of money, with amounts she said ranged from PHP 20,000.00 to PHP 40,000.00, and also gave smaller amounts to her siblings.
The victim recounted specific incidents: in a December 2017 restaurant trip, Kim requested lights be turned off in the jeep and touched her breasts while the trip was ongoing; she cried and could not explain what happened when asked by aunts. In January 2018, Kim pressured her to join him in a room and demanded sexual intercourse before taking her out, while she refused and left the room. In February 2018, she was again told to enter the room because her parents said Kim only wanted to talk; she testified that Kim kissed her, persisted despite her refusal, and forcibly kissed her again when she resisted, while her parents scolded her and threatened poverty. She testified that Kim placed his hand on her vagina through her pants and gave her PHP 20,000.00 on the same day. She also testified that Kim demanded her to lie down while positioning himself on top of her and that she repeatedly refused and pushed him away. In March 2018, Kim gave her PHP 40,000.00 and again conditioned her alleged birthday celebration on sexual intercourse; because she refused, no celebration occurred. She later recounted that in March 2018 after a drinking session, Kim forced her to touch his penis, and she described coercion and physical persistence despite her attempts to withdraw.
She further testified that her parents were aware of Kim’s sexual harassment because, during drinking sessions, Kim would touch her in front of them, yet they never intervened. Her final encounter was on March 15, 2018, when her mother called her home because Kim was looking for her. After she arrived, Kim placed his hand on her lap while she attempted to cover herself with a book. Later that night, she slept in a room, but she was awakened when NBI agents entered their room. She testified that Kim was sleeping beside her and embracing her at the time NBI agents entered. The agents witnessed this and arrested Kim, and the parents were also arrested. The group was brought to the NBI headquarters.
Testimony Supporting the Trafficking Theory
The aunt, BBB276117, testified as an interpreter because she understood what Kim was saying to the parents and vice versa. She confirmed that the parents offered the minor to Kim and that she served as a conduit for coaxing the victim. She corroborated that Kim promised to throw a birthday celebration but conditioned it on sexual intercourse with Kim. She also acknowledged executing a Sinumpaang Salaysay Ng Pag-uurong Ng Habla in the context of recantation, stating that she did so out of sympathy for her sister, YYY276117, and that Kim persuaded her to sign the document. She testified that on March 13, 2018, she and AAA276117 went to the NBI headquarters to file a human trafficking complaint, and she executed a Sinumpaang Salaysay to attest to the claims made.
Rescue Operation and Warrantless Arrest
The NBI formed a rescue operation team comprising agents including SA Santiago and SA Dela Cruz, together with SWO Romano of the DSWD, to rescue AAA276117. On March 13, 2018, the team visited the victim’s house at around 7:00 p.m. SA Santiago observed men having a drinking session in front of the house, including Kim and XXX276117, and observed YYY276117 and her children inside. She described two rooms: one room had a mattress on the floor, while the other room had a neatly made bed that was unoccupied. At around midnight, SA Santiago saw Kim stand up and enter the room where AAA276117 was sleeping. Kim attempted to wake her and then left, speaking briefly with XXX276117 before departing for xxxxxx.
On March 15, 2018, around 10:00 p.m., the team returned to continue the rescue operation. SA Santiago again observed Kim and XXX276117 drinking in front of the house, while YYY276117 and her children slept in one room. Kim entered the other room and slept. Before midnight, SA Santiago saw Kim stand up, speak with XXX276117, and then proceed into the room where AAA276117 was sleeping. When SA Santiago saw Kim lay beside AAA276117 and begin touching her breasts and vagina, she alerted the team. The team immediately entered, and Kim, XXX276117, and YYY276117 were arrested. SA Dela Cruz corroborated the rescue operation and testified that she observed Kim embracing and touching AAA276117’s breast upon the team’s entry. SWO Romano approached AAA276117, took her out of the room, and later presented video footage of the arrest and rescue in open court.
Defense and Theories of Extortion, Absence of Criminal Design, and Impropriety of Arrest
Kim, XXX276117, and YYY276117 denied the charge. Kim alleged that the complaint was filed to extort money from him. He stated that on March 11, 2018, BBB276117 demanded PHP 500,000.00 to avoid imprisonment, and later claimed that during his detention at the NBI, SA Santiago demanded PHP 3,000,000.00 and demanded additional sums, culminating in a supposed retrieval of PHP 700,000.00 from his cash box and a coerced acknowledgment receipt of PHP 400,000.00. Kim also claimed that when he refused to comply with later demands, BBB276117 allegedly left, and he asserted that he later asked counsel to file charges against BBB276117 and the NBI agents. Kim and his witnesses uniformly sought to cast the proceedings as abusive and manufactured.
XXX276117 and YYY276117 claimed that their relationship with Kim was based on friendship and that Kim was generally kind, including giving small amounts of money to the family and their children. They disputed that the parents offered their daughter for sexual exploitation and claimed that AAA276117 was used and instructed by BBB276117 to testify in a particular way. YYY276117 claimed that she was harassed during the arrest, asserted she could not speak English, and denied that Kim paid her or that her family received money in the manner attributed by the prosecution. CCC276117, another family member, likewise portrayed Kim as kind and testified that on March 15, 2018, Kim was at their house drinking and that the next morning the parents were taken away amid AAA276117’s cries.
RTC and CA Dispositions
On February 14, 2020, the RTC rendered a decision convicting all three accused of qualified trafficking in persons. The RTC imposed the penalty of life imprisonment and a fine of PHP 2,000,000.00 on Kim and XXX276117, while it sentenced YYY276117 to imprisonment of fifteen (15) years and fine of PHP 500,000.00. The RTC also awarded moral damages and exemplary damages to the victim and ordered interest at six percent (6%) per annum from finality until fully paid.
On appeal, the CA dismissed the appeal for lack of merit and affirmed the conviction for qualified trafficking, but modified YYY276117’s participation by changing her liability from accomplice to principal conspirator. The CA rejected Kim’s extortion story and drunkenness claims. It held that Kim was caught in flagrante delicto during the NBI rescue operation and that the parents and Kim were guilty beyond reasonable doubt based on the coordinated acts showing an agreement and unity of purpose. The CA increased YYY276117’s penalty by ordering life imprisonment and a fine of PHP 2,000,000.00, and it imposed solidary damages to the minor.
Kim filed a motion for reconsideration before the CA, but Kim died on May 20, 2023 before the CA could act on the motion. The CA dismissed the motion and dismissed the criminal case against Kim because death extinguished criminal liability and civil liability ex delicto.
