Prosecution's Account

The meeting ended with Agent Peralta executing a pre-arranged signal after Toukyo produced the brick of marijuana, leading to his arrest. Subsequently, Toukyo was charged with illegal sale, and the marijuana was marked as evidence immediately after the arrest.
Defense Argument
In response to the charges, Toukyo denied any involvement in drug trafficking, claiming he was simply with a companion named Bonifacio, who left him with a backpack containing the marijuana. He argued that he was a victim of a set-up and that the arresting agents coerced a confession from him.
RTC Ruling
The RTC convicted Toukyo of illegal sale of dangerous drugs and sentenced him to life imprisonment along with a fine of P5,000,000. CA Ruling

Despite this, the CA affirmed that Toukyo was in illegal possession of the marijuana, which constituted a lesser included offense.
