Case Summary (G.R. No. 112620-21)

Incident Overview

Medrano and Rebujio were on their way to Cabuaan, Natividad, Pangasinan to inspect a cow for sale. They were ambushed while riding a motorcycle when they encountered bamboo poles obstructing the road. At this moment, they noticed two assailants, later identified as Pagal and Lamqui, who opened fire with an armalite rifle and a short firearm. Medrano sustained multiple injuries but managed to go to the hospital where Rebujio, who was also injured, eventually succumbed to his wounds two days later.

Medical Evidence

Medical records reveal that both men suffered serious gunshot wounds. Dr. Cesar Bulosan, who treated them, confirmed the use of a high-caliber firearm, specifically an armalite rifle, as evidenced by the gunshot wounds and the presence of powder burns which suggested the shots were fired at close range. Rebujio’s death was attributed to cardiorespiratory arrest due to massive internal hemorrhage caused by his gunshot injuries.

Identification of the Assailants

Following the attack, Patrolman Orlando Arciaga interviewed the victims at the Eastern Pangasinan District Hospital, where they identified the assailants as Pagal and Lamqui. Medrano subsequently took the stand and corroborated these identifications, noting his familial relationship with Pagal and their history of business dealings, which had soured following a prior violent incident between the families.

Defense Claims

The accused-appellants denied the charges, claiming they were helping to construct a house in Barangay Calapugan at the time of the ambush. Their alibi was supported by witnesses who claimed they were present at the construction site. However, the proximity of Barangay Calapugan to the site of the ambush in Barangay San Miguel was a critical factor in the analysis of their alibi.

Trial Court Proceedings and Conviction

After the proceedings, the RTC issued a verdict on September 23, 1993, convicting both accused of murder and attempted murder, imposing sentences of reclusion perpetua for the murder of Rebujio and imprisonment for the attempted murder of Medrano. They were also ordered to pay damages to the victims' families.

Appeal and Court Findings

The accused appealed, arguing the trial court erred in its conviction based on their claims of innocence and insufficient evidence. However, the appellate court found the arguments unconvincing. The presence of powder burns and the identification of the accused by Medrano, despite their claims of being elsewhere, were deemed credible. Furthermore, the negative findings from the paraffin tests were not conclusive proof of their innocence, as such tests can yield false negatives.
