Police officers, during the operation, confirmed the sale of shabu where the appellant allegedly handed over two sachets in exchange for marked money. Following the transaction, when the police entered the premises, they recovered additional quantities of the drug.
Version of the Defense
Noque countered that he was a victim of a wrongful arrest. He argued that he was initially not involved in any illegal activity and claimed that the police fabrication of evidence was aimed at implicating him. Furthermore, he stated that at the time of his arrest, he was merely a victim of circumstances when the police apprehended another individual adjacent to his residence.
Ruling of the Regional Trial Court
On February 28, 2003, the RTC convicted Noque in both cases based on the established evidence by the prosecution, including corroborative eyewitness accounts from the police officers involved in the buy-bust. The court dismissed Noque’s alibi as merely self-serving and indicated that the presumption of regularity in the performance of police duty remained intact, thus siding with the prosecution.
Ruling of the Court of Appeals
The Court of Appeals upheld the RTC's convictions on appeal, clarifying that the classifications of drugs as regulated under Republic Act No. 6425 included substances like ephedrine, from which methamphetamine could be synthesized. It modified the penalty for the sales charge in Criminal Case No. 01-189458, but affirmed the trial court's ruling in Criminal Case No. 01-189459.
