Criminal Charges and the Trial Court’s Result

In Criminal Case No. Q-20893, the complaint alleged that, in or about May 1982, in Quezon City, the accused—with lewd design—had carnal knowledge of MA. THERESA AGUILAR, who was six years old, against her will, in her own house. In Criminal Cases Nos. Q-20894 to Q-20897, the complaints charged that, in specified weeks between April and May 1982, in Quezon City, the accused, with lewd design, by means of violence and intimidation, had carnal knowledge of LUZ DELGADO against her will.

The trial court found the accused guilty beyond reasonable doubt for each count. For each count, it imposed the penalty of reclusion perpetua and ordered payment of indemnity of P30,000.00.

Prosecution’s Evidence on the Circumstances of the Alleged Rapes

The prosecution established that, in late 1978, the accused met Adelaida Masupil, who was the maternal aunt of Theresa. They worked in the office of an architect. The evidence showed that the accused was a married man, although Adelaida did not know this at the start. About six months later, the accused became Adelaida’s boyfriend, and they eloped after Valentine’s Day in 1979. After confessing he was married, the couple lived for about a year in the house of the accused’s mother in Bacolor, Pampanga.

In December 1980, Adelaida’s sister Toribia Aguilar invited the couple to live at their house at 35 Scout Castor Street, because Toribia would go on business to Japan and Korea and wanted the children cared for while their mother was abroad. The evidence indicated that the accused worked as a draftsman, doing much of his work in a second-floor bedroom, where he kept tools and a long knife used to cut drafting paper.

Adelaida testified that, after they moved into Toribia’s house, the accused’s demeanor changed, particularly with respect to Theresa. She testified that she observed the accused touch Theresa’s vagina about three times when Theresa was about four years old. After the first observation, she ignored it; after the second, she advised Theresa to tell the accused to stop if he did it again. She then confronted the accused, who denied wrongdoing and claimed he was merely playing with the children. She also recalled that the accused engaged in playful banter with the maid Luz, and that Luz’s voice and manner aroused suspicion, though Adelaida did not personally witness any act then.

Adelaida further testified to circumstances that increased her concern. She recalled an instance when she returned home at 7:30 p.m. and saw the accused and Theresa watching television with the lights off, and she found this suspicious because the lights were said to be off though the TV was on. Luz also testified about maltreatment when children misbehaved and about fear that Luz had of precipitating conflict, including the fear that the accused might kill the children.

Luz Delgado’s Testimony: Four Rapes by Force and Intimidation

Luz testified that the accused raped her four times in the summer of 1982. She identified the first rape as occurring in the first week of April, at about 2:00 p.m., when only the children were at home and the father, Antonio Aguilar, was in Japan. She testified that the accused summoned her to his second-floor bedroom, locked the door after she arrived, and threatened her with a knife about eight inches long. She narrated that the accused used pornographic photos, forced her to read literature, held her arms pinned beyond her head, and compelled her to lie down. He removed her panty and removed his shorts. When she attempted to run away, he boxed her and then forced penetration, causing pain. She believed she bled and observed blood. Luz testified that she did not report the first incident to Toribia, fearing the accused’s threat to kill her.

Luz testified that she informed a houseboy, Danilo, after the first incident, but it was not until after the fourth incident that Danilo told Toribia. For each subsequent rape, Luz maintained that the accused used intimidation, threats, and physical dominance to prevent her from shouting or resisting. She testified to the second rape in the second week of April at about 4:00 p.m., when she was fixing clothes in the maid’s room on the ground floor. She claimed the accused locked the door when she demanded that he leave and threatened to kill all the children if she screamed. She also testified that he held a hand over her mouth to prevent her from shouting, and he raped her again. She testified that after it, the accused repeated the threat.

She testified to the third rape in the third week of May in the afternoon. She recounted that the accused ordered her to fetch a drawing from his upstairs bedroom. When she hesitated, he shouted; he followed her upstairs, locked the door, and forced penetration after taking up the knife. She testified that he warned her not to tell anyone after he ejaculated. She described the fourth rape in the fourth week of May at about 11:00 p.m., when she was in the children’s bedroom, sleeping in a separate bed while the children slept in their bed and the bedroom door was locked. She testified that the accused entered through an adjoining bathroom, lay beside her, placed a hand over her mouth, brandished the knife, warned her not to make a sound, and then raped her while they remained undisturbed by the children.

Luz testified that after each rape she was afraid, could not sleep, and chose not to wake or disclose the incidents because she wanted to shield the children from the reality of the abuse. She later claimed that Theresa’s disclosure emboldened her to finally report what happened.

Theresa Aguilar’s Testimony: Statutory Rape as a Victim Under Twelve

Theresa testified that, on a Sunday, 30 May 1982, after the accused and Adelaida went out to church, she told her mother what happened. The prosecution narrated that Adelaida and the accused later went to Pampanga to fetch Adelaida’s things and did not return right away, leading to family speculation that the accused held Adelaida hostage.

Theresa’s disclosure was the pivot for subsequent reporting. Luz testified that Theresa had been playing downstairs in May, when the accused called Theresa to his second-floor bedroom, and Theresa dutifully complied. Luz testified that, in the room, the accused made Theresa lie down, removed her panty and shorts/briefs, and placed his penis on Theresa’s vagina, causing pain. Luz also testified that during the second rape involving Theresa, her sister Aurea, age five, was in the same room and the accused ordered both girls to sleep. Luz testified that the accused inserted his finger into Theresa’s vagina, and both acts produced pain. Luz further claimed that Theresa’s parents arrived around 9:00 p.m., but Theresa did not tell them because the accused was present and she was afraid.

After Theresa told her mother on 30 May 1982, Adelaida and the accused left and did not return immediately. When the family discussed the disappearance, Toribia noticed Luz’s reaction and ordered Luz upstairs. Luz did not obey and instead burst into tears and revealed that the accused raped her.

Medical and Investigative Evidence

After Theresa and Luz disclosed the alleged rapes, the family sought medical assistance. The prosecution evidence showed that on the lawyer’s suggestion, they brought Theresa to Capitol Medical Center and reported that Theresa complained of itchiness in the vagina. However, upon learning that Theresa was actually alleging rape, the doctor refused to issue a medical certificate and suggested going to Camp Crame or the NBI. Toribia hesitated due to fear of further traumatizing her daughter.

Subsequently, Toribia took the two girls to the PC crime laboratory. The medico-legal officer issued a clinical history report on Luz (Exhibit "J") and another on Theresa (Exhibit "H"). A letter-request was sent to the head of the crime laboratory, and the prosecution presented the examinations and medico-legal findings. The examiner submitted a medico-legal report for Theresa, stating that there were no external signs of recent application of any form of trauma, smears were negative for spermatozoa, and physically Theresa was still a virgin. However, the examiner found the vulvar area congested and reddish, which may have been caused by an attempt to forcibly insert the penis, with possible penetration of the labia majora and labia menora but not the hymen.

The medico-legal report on Luz stated there were no external signs of recent application of any form of trauma, healed lacerations were found, smears were negative for spermatozoa, and physically Luz was no longer a virgin. The report indicated that the lacerations showed that there were more than one act of sexual intercourse. Because the lacerations were healed, the intercourse could have taken place about two months before examination.

Investigators later took statements from Luz, Theresa, and Toribia on 2 July 1982. The trial court also noted that Theresa’s failure to pass Grade I and the resulting repetition of Grade I, and that she was to repeat Grade 2 as well, were tied to the trauma of the rapes.

The Accused’s Defense and Arguments on Appeal

The accused denied the charges. He claimed that the Aguilar family trumped up the allegations to keep him away from Adelaida. He attributed the physician’s findings on Luz to her alleged affair with a houseboy named Danilo. He claimed that Theresa’s testimony was the product of hyperactive imagination influenced by pornographic movies shown on television, asserting that it led Theresa to fantasize copulation with him.

In his appellant’s brief, he argued that the prosecution evidence was fatally flawed and insufficient to prove guilt beyond reasonable doubt; that the conduct of the complainants after the alleged rapes cast doubt; and that the testimony and evidence were insufficient to convict.
