In a prior unlawful detainer action (Civil Case No. 5123-08), the brothers Ngo succeeded against the spouses Anatalio, leading the latter to file an appeal (Civil Case No. 3624-09) to the RTC. In their Memorandum of Appeal presented to the RTC, the Anatalios attached a document titled "Bilihan ng Lupa," which Frades certified as a "Certified True/Xerox Copy." Ngo later sought certification from Frades to confirm the document's existence, but received no response. Furthermore, Ngo alleged that he paid Frades P30,000.00 for demolition expenses, although the defendants voluntarily demolished their houses, leading to claims of misappropriation of funds by Frades.

Respondent's Defense

Frades denied the allegations in his Comment, arguing that he issued the certification at the request of the RTC's presiding judge in light of the absence of a Branch Clerk of Court. He claimed that his actions were in line with his official duties. The investigation was subsequently referred to Executive Judge Celso O. Baguio, who noted that Frades' assertion about being tasked with the certification was contradicted by testimony from Judge Wilfredo L. Maynigo, the judge from the prior case.

In his Investigation Report, Judge Baguio concluded that Frades was culpable for several administrative violations, including falsely certifying the "Bilihan ng Lupa" document, misappropriating P30,000.00 from the complainant for demolition that never occurred, and failing to act in accordance with established procedural guidelines. The Office of the Court Administrator (OCA) supported the findings of Judge Baguio and recommended that Frades be re-docketed as a regular administrative matter and found guilty of Serious Dishonesty, Gross Neglect of Duty, and Grave Misconduct.
