Allegations of the Complainants

The complainants allege that on March 9, 2016, Atty. Amazona notarized a letter dated March 7, 2016, which was signed by Michelle B. Lotho, the Director and Auditor of South Forbes Phuket Mansions Homeowners Association, Inc. This letter, addressed to Loiue A. Odiamar, stated that a majority of the subdivision lot purchasers were overseas, making it difficult to secure their signatures for the registration of the homeowners association. The complainants contend that this assertion was misleading and known to be false by the respondent, as he had maintained ongoing communication with the residents. Furthermore, the complainants argue that the list of members and their signatures attached to the letter was inaccurate, as it referred to an entirely different meeting.

Recommendation of the Integrated Bar of the Philippines

In the Report and Recommendation dated January 12, 2017, Investigating Commissioner Jose Villanueva Cabrera recommended the dismissal of the complaint against Atty. Amazona for lack of merit. Commissioner Cabrera noted that notarizing the letter was not a violation of the Notarial Rules, as Atty. Amazona's role was limited to verifying the presence of Lotho before him and attesting to her signing of the document. The truthfulness of the letter's content was deemed the responsibility of the affiant, Lotho.

IBP Resolution

On January 26, 2017, the IBP Board of Governors adopted the findings and recommendations of Commissioner Cabrera, leading to the dismissal of the complaint. The Board concluded that the evidence presented did not suffice to establish a violation on the part of Atty. Amazona.
