Factual Antecedents

Delaying Payment

Criminal Charges

Sandiganbayan Decision
On February 4, 2010, the Sandiganbayan ruled against Mayor Gutierrez, establishing that all elements of the crime were satisfied: she was a public officer (Mayor), acted with evident bad faith in refusing to pay the gratuity despite having no just cause to withhold it, and caused undue injury to Dr. Corral by not releasing the gratuity pay. She received a sentence of imprisonment and was disqualified from holding public office.
Motion for Reconsideration
Mayor Gutierrez filed for reconsideration, arguing that she acted prudently given the investigations against Pulvinar, and claimed that the prosecution did not demonstrate evident bad faith or undue injury. The Sandiganbayan, however, denied her motion, upholding its initial decision.
