Factual Antecedents

Following the death of Mayor Naomi Corral on April 6, 1996, her husband, Dr. Corral, sought payment of her gratuity pay. After Mayor Gutierrez assumed office on July 11, 1996, she received reports of irregularities in the Municipal Treasurer's office and took steps to investigate, prompting her to request financial reports from Treasurer Corazon Pulvinar. Although a municipal clearance for the gratuity pay was issued on July 10, 1996, Mayor Gutierrez raised concerns over irregularities linked to Pulvinar’s management.

Delaying Payment

Mayor Gutierrez engaged in various administrative and investigative actions against Pulvinar without processing the gratuity claim. Despite approvals from the Government Service Insurance System (GSIS) and the Sangguniang Bayan for the payment, Gutierrez repeatedly instructed that the payment be withheld pending further inquiries, resulting in prolonged non-payment of the gratuity.

Criminal Charges

Dr. Corral eventually filed a complaint against Mayor Gutierrez with the Sandiganbayan, alleging that her refusal to pay the gratuity constituted a violation of Section 3(e) of R.A. No. 3019, which prohibits public officials from causing undue injury through manifest partiality, evident bad faith, or gross negligence. Mayor Gutierrez pleaded not guilty, but the Sandiganbayan ultimately found her guilty of the charges.

Sandiganbayan Decision

On February 4, 2010, the Sandiganbayan ruled against Mayor Gutierrez, establishing that all elements of the crime were satisfied: she was a public officer (Mayor), acted with evident bad faith in refusing to pay the gratuity despite having no just cause to withhold it, and caused undue injury to Dr. Corral by not releasing the gratuity pay.
