Initial Applications for Land Registration

In July 1918, Martin Gonzalez filed an application for the registration of a substantial tract of land. Shortly thereafter, Sisenando Turla submitted his application for the registration of a 49-hectare portion of the same tract. The conflicting applications were collectively tried in the Court of First Instance, which ultimately rejected Turla's application while granting registration to Gonzalez.

Appeal and Modification of Initial Judgment

Turla subsequently appealed the denial of his application. Upon review, the higher court reversed the initial judgment regarding Turla's application and registered the contested parcel of land in his favor in 1922. Concurrently, Ponciano Mauricio presented a claim to a large portion of Gonzalez's registered lot, resulting in the court’s refusal to reopen the case. Mauricio pursued mandamus proceedings which led to the remand of the case for a hearing on his opposition.

Final Decrees and Subsequent Actions

After further adjudications, the Court of First Instance reaffirmed the land's registration to Gonzalez, prompting Mauricio to appeal. Despite the intertwined nature of Turla's claims, he did not file an appeal after the new trial, mistakenly believing his previous appeal to be sufficient. The court, on December 31, 1927, subsequently clarified its previous ruling by ordering the registration of Gonzalez’s land, including the disputed parcel claimed by Turla.

Denial of Modification Requests

On January 17, 1928, Turla sought modification of the court's decision to ensure the disputed portion between him and Gonzalez was excluded from the effects of that decision. This motion was denied on the grounds that the court lacked jurisdiction to permit further appeal due to the expiration of the appeal period.

Appeal and Final Judgment
