Case Summary (Adm. Matter No. MTJ-93-795)

Allegations Against Respondents

Ferrer filed a grave oral defamation case against PO3 Domingo Eden, alleging that he publicly insulted her. It was then assigned to Judge Maramba's court. In her October 29, 1992 complaint, Ferrer alleged that Maramba forced her to sign an affidavit of desistance to dismiss the case against Eden and ordered the Branch Clerk of Court to deduct P5,000.00 from the settlement amount that Eden was to pay to Ferrer. Additionally, Ferrer claimed that on September 17, 1992, the judge violently dragged her to her chambers to settle with PO3 Eden, resulting in damage to her clothing and jewelry. Following this, Process Server Abrogar allegedly threatened Ferrer with dismissal if she did not settle with Eden, further exacerbating Ferrer's distress.

Responses from the Respondents

Judge Maramba denied the allegations, asserting that Ferrer voluntarily presented the affidavit of desistance. Regarding the September incident, Maramba acknowledged slapping Ferrer but claimed it was an act of self-defense to protect herself and her staff. Both Songcuan and Abrogar denied any misconduct, rejecting Ferrer's claims about the deduction from the settlement and the alleged threats by Abrogar.

Investigation and Findings

The case was referred to Judge Antonio M. Belen for investigation. The incident of forcible dragging was substantiated by witness testimonies, while further acts of violence were corroborated through evidence, including the visible damage to Ferrer’s clothing.

Judge's Behavior and Misconduct

The investigation highlighted Judge Maramba’s improper conduct and lack of judicial temperance. Her actions, including the physical altercation and public outburst during the incident, were found unacceptable in light of her position. Though the Court acknowledged that self-defense was claimed, i
