Redemption and Title Issuance
On April 7, 1956, Catagona redeemed the property by paying PHP 3,205.00 to the provincial sheriff, leading to the execution of a deed of repurchase in his favor, which was duly registered. Subsequently, on April 16, 1956, Catagona filed a motion requesting the court to order Dionisio to surrender the transfer certificate of title, which was issued to Dionisio due to the auction sale. This motion was granted by the court on April 23, 1956.
Defendant's Challenge and Appeal
On June 26, 1956, Dionisio filed a motion for reconsideration against the court's order, asserting that under applicable laws, Catagona was no longer entitled to redeem the property since the auction resulted from a foreclosure for a mortgage executed by Catagona. Dionisio's motion was denied due to lack of merit, prompting the appeal that is the focus of this analysis.
Terms of the Amicable Agreement
