Background of the Case

ALRAI filed an unlawful detainer case against Eugenio, et al. before the Branch 7 Municipal Trial Court in Cities (MTCC), Davao City. The complaint asserted that ALRAI is the registered owner of 15 parcels of land, evidenced by title documents, and alleged that the defendants, who are not members of the association, occupied these properties without consent. Following demands to vacate the properties, which were ignored, ALRAI initiated legal proceedings.

MTCC Ruling

On June 30, 2009, the MTCC ruled in favor of ALRAI, granting it possession of the properties and ordering Eugenio, et al. to vacate and pay monthly rentals and attorney's fees. The court recognized ALRAI’s proof of ownership and ruled that the defendants, having no membership claim to the association, did not have rights to the property.

RTC Branch 11 Ruling

Eugenio, et al. filed a notice of appeal, but initially failed to provide an appeal memorandum. However, upon reconsideration, RTC Branch 11 allowed the appeal to proceed. Eugenio, et al. argued that they had been in continuous and peaceful possession of a portion of the land, outside ALRAI's claim. They engaged a geodetic engineer who provided a survey supporting their position. Ultimately, on May 31, 2010, RTC Branch 11 upheld the MTCC ruling, affirming ALRAI's superior claim to the property.

Execution Issues and MTCC Orders

Eugenio, et al. later filed a motion to clarify the areas that needed to be vacated. The MTCC ordered a relocation survey, which resulted in a report confirming that Eugenio, et al.’s structures were indeed on ALRAI's titled property. Subsequently, the MTCC approved this report on May 19, 2013, and ordered the demolition of the structures owned by the defendants.

Appeal to the RTC and CA

Eugenio, et al. appealed this decision, which was initially denied. However, the RTC Branch 10 eventually granted their motion, ruling that the order of execution could be appealed due to ambiguities regarding the area to be vacated. The Court of Appeals (CA) subsequently affirmed this ruling on October 7, 2015, leading to ALRAI's petition before the Supreme Court.
