Facts:
In Noel Villanueva v. People of the Philippines and Yolanda Castro, petitioner Noel L. Villanueva, then a Municipal Councilor of Concepcion, Tarlac, filed a petition for review before the Supreme Court challenging the Court of Appeals’ decision in CA-G.R. CR No. 22932 (March 28, 2003, and October 9, 2003 resolution). Private complainant Yolanda C. Castro was Vice-Mayor of the same municipality. On September 12, 1994, petitioner brought to the Vice-Mayor’s office his application for monetization of accrued leave credits. Upon alleged refusal by the complainant to sign without valid reason, petitioner allegedly uttered insulting statements—comparing her to a worm-infested apple—and twice pointed a “dirty finger” at her in the presence of municipal officials and staff.
