Facts:
Orlando G. Umoso v. Hon. Civil Service Commission, and Severino G. Caronan, G.R. No. 110276, July 29, 1994, the Supreme Court En Banc, Mendoza, J., writing for the Court.Petitioner Orlando G. Umoso was a Senior Civil Engineer promoted by the Regional Director, Department of Public Works and Highways (DPWH) Regional Office No. 2 to the position of Supervising Civil Engineer I at the Cagayan South Engineering District. Severino G. Caronan, a Senior Civil Engineer in the Design and Planning section of the same district, filed a protest with the Regional Director claiming the promotion process was unfair and asserting that, as next-in-rank in the Planning and Design Section, he was entitled to preferential consideration for the vacancy.
The Regional Director referred Caronan’s protest to the DPWH complaints committee, which on May 7, 1990 issued a memorandum recommending that Caronan’s protest be upheld and that Umoso instead be appointed to a Senior Civil Engineer position to be vacated by Caronan. The DPWH Secretary approved the committee’s recommendation; Umoso’s motion for reconsideration of the Secretary’s action was denied by the Regional Director on October 5, 1990.
Umoso appealed to the Merit System Protection Board (MSPB). The MSPB conducted a comparative study of the qualifications of Umoso and Caronan and, in a decision dated June 28, 1991, dismissed Umoso’s appeal for lack of merit and upheld Caronan’s appointment, noting Caronan’s nine years’ direct experience in the section where the contested position was located. Umoso’s subsequent motion for reconsideration to the MSPB was denied on January 31, 1992, the Board holding that the Secretary has administrative supervision over the entire department and may review regional appointments.
Umoso then appealed to the Civil Service Commission (CSC), raising as the sole issue whether the DPWH Secretary had authority to set aside an appointment made by the Regional Director.
