Facts:
The United States v. Eulalio Morelos, G.R. No. 9768, February 20, 1915, the Supreme Court En Banc, Johnson, J., writing for the Court. The plaintiff-appellee was The United States and the defendant-appellant was Eulalio Morelos, a policeman alleged to have acted as warden (alcaide) of the Tondo police station jail in Manila; the offended party was Tomasa Clemente.On or about September 18, 1913, Tomasa Clemente was a prisoner in the Tondo police station. Morelos was in charge of prisoners at that police station the night in question. A complaint charged that Morelos entered Clemente’s cell while she was asleep, "placed himself upon her, insert[ed] his sexual organ" into her genitalia and had carnal intercourse with her, together with making unchaste proposals. Morelos was arrested, arraigned, pleaded not guilty, tried, found guilty, and sentenced to three years, six months and twenty-one days of prision correccional and eleven years and one day of inhabilitacion temporal especial, plus costs, under Article 380 of the Penal Code.
