Facts:
Emmanuel Timbungco v. Hon. Ricardo C. Castro, et al., G.R. No. 76111, March 14, 1990, First Division, Narvasa, J., writing for the Court. Petitioner Emmanuel Timbungco was president of the labor organization Kapisanan ng Manggagawa sa Associated Anglo American Tobacco Corporation ("Kapisanan"), the certified bargaining agent of employees of Associated Anglo American Tobacco Corporation ("AAATC"). Kapisanan had a three‑year collective bargaining agreement (CBA) with AAATC expiring August 24, 1984.Within the 60‑day "freedom period" before expiration of the CBA, a general membership meeting was held on July 15, 1984 at which the members allegedly amended the constitution and by‑laws, voted to disaffiliate from the mother union Federacion FOITAF, and elected officers with Timbungco re‑elected president. The minutes showed members dispensed with forming a COMELEC and did not prepare a tally sheet; nominations and individual listings were used instead. On July 23, 1984 Timbungco filed with the Bureau of Labor Relations (BLR) the amended constitution/by‑laws, minutes of the July 15 meeting, an affidavit declaring Kapisanan as sole collective bargaining agent, and a resolution of disaffiliation; a new registration certificate followed.
In September 1985 Timbungco and Kapisanan commenced negotiations with AAATC, culminating in a new three‑year CBA which was filed with the BLR as required by Policy Instruction No. 17. On April 8, 1986 one Leodegario Zapanta (for ADLO) informed the BLR that a majority of Kapisanan members had affiliated with ADLO; ADLO and a member, Delicano Pajares, later asked AAATC to stop deducting dues or hold them in trust pending resolution of the representation issue. AAATC refused.
On April 23, 1986 Delicano Pajares filed with the BLR a petition for election of officers (NCR LRD‑M‑4‑234‑86), alleging invalidity of the July 15, 1984 election and claiming the support of 700 workers. Med‑Arbiter Danilo Reynante issued an Order dated July 3, 1986 declaring the July 15, 1984 election invalid and ordering a supervised election at AAATC. Director Cresenciano Trajano of the BLR affirmed that Order in a Resolution dated September 9, 1986, and OIC Director Ricardo C. Castro denied Timbungco's motion for reconsideration on September 30, 1986.
Timbungco filed a special civil action for certiorari in this Court seeking annulment of the med‑arbiter's Order and the BLR Resolutions. This Court previously issued a temporary restraining order (TRO) on November 17, 1986; the TRO's dissolution is addressed in the judgment.
