Facts:
In Valentin Susi v. Angela Razon and the Director of Lands (48 Phil. 424, decided December 9, 1925), Valentin Susi filed a complaint in the Court of First Instance of Pampanga against Angela Razon and the Director of Lands. He prayed that he be declared sole and absolute owner of the disputed parcel, that the sale by the Director of Lands to Angela Razon be annulled on the ground that the land was already private property, that Razon’s certificate of title be cancelled, and that she pay ₱500 damages. In his answer, the Director of Lands contended that the lot was public domain under U.S. administration and had been lawfully sold to Razon. At trial both sides introduced evidence. The trial court rendered judgment in favor of Susi, declaring his ownership, annulling the sale to Razon, and ordering cancellation of her title. The Director appealed, assigning error in the trial court’s reliance on a prior forcible entry judgment, its declaration that Susi was entitled to possession,Case Digest (G.R. No. 100382-100385)

- August 15, 1914 – Razon applied to purchase the land from the Director of Lands; Susi filed opposition December 6, 1915, asserting 25-year possession.
- After administrative investigation, the Director overruled Susi’s opposition and, on August 31, 1921, issued a certificate of title to Razon.
- Razon demanded Susi’s ejectment; he refused; Razon filed forcible entry in Justice of the Peace court, which was dismissed for lack of jurisdiction.

Issues:
- Validity of the Director of Lands’ Sale
- Whether the parcel had ceased to be public domain and thus beyond the Director’s power to sell.
- Whether Susi’s possession and statutory presumption of grant precluded the sale to Razon.
- Susi’s Capacity to Sue for Possession
- Whether Susi, as a party in possession but without a formal certificate, could maintain an action for recovery of possession.
- Whether the prior judgment in the forcible entry case against Razon was binding in this proceeding.
- Proper Application of Legal Presumptions and Precedents
- Whether the presumption juris et de jure under section 45(b), Act No. 2874 applied to Susi.
- Whether Carino v. Government of the Philippine Islands (212 U.S. 449) governed the construction of such presumptions.
