Facts:
This is Leovegildo R. Ruzol v. The Hon. Sandiganbayan and The People of the Philippines, G.R. Nos. 186739-960, April 17, 2013, Supreme Court Third Division, Velasco Jr., J., writing for the Court. Petitioner Leovegildo R. Ruzol (then Mayor of General Nakar, Quezon) sought to nullify the Sandiganbayan First Division’s December 19, 2008 Decision that convicted him of 221 counts of Usurpation of Official Functions under Article 177 of the Revised Penal Code; his co-accused Guillermo T. Sabiduria (municipal administrator) was acquitted by that court.During Ruzol’s 2001–2004 term, he convened a Multi-Sectoral Consultative Assembly of local stakeholders, DENR representatives (including PENRO Rogelio Delgado Sr.), NGOs and religious leaders to regulate and monitor transportation of salvaged forest products. The participants agreed that the Office of the Mayor would issue “Permits to Transport” upon payment of fees to the municipal treasurer. Between 2001 and 2004, 221 such permits were issued—43 signed by Ruzol and 178 by Sabiduria.
In June 2006, on the basis of those permits, the People filed 221 Informations (Criminal Case Nos. SB-08-CRIM-0039 to 0259) charging both municipal officers with violation of Art. 177 RPC. During pre-trial the parties stipulated facts and dispensed with testimonial evidence; the case was submitted on documentary evidence and memoranda. The Sandiganbayan found that authority to issue transport permits for salvaged forest products rested exclusively with the Department of Environment and Natural Resources (DENR), and thus that Ruzol usurped DENR functions; it acquitted Sabiduria for reasonable doubt.
