Re: Anonymous Letter-Complaint Against Hon. MTJ‑04‑1558 (Formerly OCA IPI No. 04‑1594‑MTJ), April 07, 2010, the Supreme Court En Banc, Per Curiam.An anonymous letter dated October 22, 2003, sent to then Chief Justice Hilario G. Davide, Jr., alleged that Judge Marilou D. Runes‑Tamang indiscriminately approved “fake bonds” issued by Covenant Assurance Company, Inc. for a fee, and suggested involvement of certain court employees and an arresting officer. The Chief Justice referred the letter to Deputy Court Administrator Christopher O. Lock, prompting an OCA inquiry which found that Covenant had been blacklisted since December 20, 2002, yet numerous bail bonds issued by Covenant had been approved by Judge Tamang, some for cases pending in the RTC of Pasig although approvals occurred in her MeTC San Juan sala. The OCA limited its review to bonds from January 2003 to June 2004 and compiled records showing many irregular approvals and procedural defects in the supporting documents.
The Court en banc treated the OCA memorandum of June 29, 2004 as an administrative complaint and docketed the matter as A.M. No. MTJ‑04‑1558, directed Judge Tamang to answer, declared Covenant bonds after 20 December 2002 null and void, and instructed concerned RTC judges to require new, accredited bonds. Judge Tamang filed answers admitting some lapses, explained she relied on branch personnel, issued internal memoranda (Nos. 001‑03, 002‑03, 003‑03) after discovering irregularities, and produced some evidence of after‑hours signings and attempts at internal corrective measures. Branch Clerk Eleanor A. Sorio and process server Ronnie Medrano were later included as respondents after the OCA recommended their inclusion; Medrano ultimately admitted wrongdoing in a Tugon/Salaysay.
The Court referred the matter to Executive Judge Amelia C. Manalastas of the RTC, Pasig for investigation. Judge Manalastas conducted hearings (Oct. 8 & 16, 2007) and, in her report (Nov. 29, 2007), found no proof of bad faith or deliberate intent by Judge Tamang but recommended a finding of gross negligence against the judge and grave misconduct against Sorio and Medrano, proposing admonition for the judge and suspension for the others.
