Facts:
On May 14, 2007, national elections were held for twelve (12) seats in the Philippine Senate. Eleven candidates with the highest votes were proclaimed and took their oaths, leaving the twelfth seat contested between petitioner Aquilino L. Pimentel III and private respondent Juan Miguel F. Zubiri. The Commission on Elections (COMELEC) en banc, acting as the National Board of Canvassers (NBC), continued to canvass the Provincial and Municipal Certificates of Canvass (PCOCs and MCOCs) from Maguindanao after removing the original PCOC prepared by Provincial Election Supervisor Lintang Bedol due to alleged fraud and statistical anomalies. A Special Provincial Board of Canvassers for Maguindanao (SPBOC-Maguindanao) chaired by Atty. Emilio S. Santos was formed to re-canvass 21 copy-2 MCOCs collected mostly from posted sets rather than official copy-1s. - On May 14, 2007, Philippine voters elected 12 senators; 11 winners were proclaimed and sworn in soon after. The twelfth seat was contested by Aquilino L. Pimentel III and Juan Miguel F. Zubiri.

- SPBOC submitted the second Maguindanao PCOC on June 29, 2007. At the NBC canvass, Pimentel’s counsel again sought to question officials and move for exclusion; both requests were denied. 2. Inclusion of the second PCOC reduced Pimentel’s lead from 133,000 to about 4,000 votes.
- Pimentel alleged violations of substantive/procedural due process, equal protection, and grave abuse of discretion; prayed for TRO or status quo ante, annulment of the canvass acts, and mandamus to compel proper questioning.
- Subsequent Developments
- On July 14, 2007, NBC Resolution 07-67 proclaimed Zubiri as the twelfth senator (lead of 19,292 votes). Zubiri took oath July 16, 2007.
- Zubiri moved to dismiss Pimentel’s Petition, invoking the exclusive jurisdiction of the Senate Electoral Tribunal (SET) over post-proclamation contests.
