Facts:
People of the Philippines v. Jeanette (Ginette) Yanson‑Dumancas, et al., G.R. Nos. 133527-28, December 13, 1999, Supreme Court Third Division, Melo, J., writing for the Court.The prosecution charged several respondents (accused‑appellants) in two Informations (Crim. Case Nos. 94‑15562 and 94‑15563) with kidnapping for ransom with murder for the abduction, detention, and subsequent killing of Rufino Gargar, Jr. and Danilo Lumangyao in August 1992. The informations named Jeanette Yanson‑Dumancas, Charles Dumancas, Police Col. Nicolas M. Torres, Police Inspector Adonis C. Abeto, several police officers and civilian accomplices, and two alleged accessories who buried the bodies. The complaints alleged a conspiracy to extort P353,000 and recited aggravating circumstances (premeditation, treachery, nocturnity, use of a motor vehicle).
All accused (except Edgar Hilado, initially at large) pleaded not guilty at arraignment on February 14, 1994. A joint trial was conducted; the trial court found evidence of abduction, detention, interrogation, transportation of the victims to several motels and to a remote sitio, the shooting deaths of the victims, and burial in a shallow grave. The trial court convicted nine accused (including Jeanette, Col. Torres, Inspector Abeto, and several others) and acquitted Charles Dumancas, Police Officers Jose Pahayupan and Vicente Canuday, Jr. The convicted principals were sentenced to reclusion perpetua and ordered jointly and severally to pay assorted civil indemnities; Cesar Pecha was convicted as accessory and given a shorter prison term.
All ten convicted accused filed notices of appeal and the cases reached the Supreme Court for review. The Solicitor General filed briefs and the Court reviewed the trial record, including the trial court’s factual summary (which the Court reproduced at length) and the testimony of eyewitness/state witness Moises Grandeza. The Supreme Court then issued the decision under review.
