Facts:

Police investigation traced the killing to Room 106 of the Taculing Court Apartelle where bloodstains were observed; inquiries and subsequent arrests led to the detention of Edilberto Norada, Eugene Villanueva (appellant), and Agustin Seva. Victim’s mother, Rosalina Pacil, testified as to the victim’s income and that Villanueva was a friend who often visited their house.
At trial the prosecution presented Norada’s sworn narrative that the three men conspired to kidnap a wealthy Canadian friend of the victim (Ray Truck), changed plans when Truck did not appear, and attempted to kidnap Pacil; Norada admitted striking Pacil on the head with a piece of wood when Pacil resisted, after which they wrapped and dumped him. Appellant’s account claimed he and Pacil struggled after Pacil allegedly tried to use him, that Norada unexpectedly entered and hit Pacil with a piece of wood, and that he and Norada panicked, wrapped Pacil, and dumped him. Medical evidence showed lacerations and fractures consistent with blunt instrument trauma.
The Regional Trial Court (RTC), Branch 50, Bacolod City, convicted all three on July 21, 2006 of the complex crime of Attempted Kidnapping with Murder (as conspirators and principals) and imposed reclusion perpetua with accessory penalties and awarded civil damages.
