Facts:
People of the Philippines v. Edgardo Salvador y Kiamco and Ricardo Manosca y Toluwa, G.R. No. 77964, July 26, 1988, Supreme Court Second Division, Sarmiento, J., writing for the Court. The respondents were the accused: Edgardo Salvador y Kiamco (accused-appellant) and Ricardo Manosca y Toluwa (co-accused). On the evening of August 20, 1985, at about 8:30 p.m., Alfredo C. Mabuhay, Jr. and his companion Susan Esmao were at a grassy area within the Cultural Center of the Philippines (CCP) complex when two men approached them. According to the prosecution version, the two assailants simultaneously accosted the couple, announced a hold-up while brandishing knives, held each victim down, and divested them of valuables—Manosca taking Alfredo’s wallet and Salvador taking Alfredo’s wristwatch.
The prosecution further alleged that while Salvador restrained Alfredo, Manosca stabbed Alfredo repeatedly and then stabbed Susan multiple times, causing her death; Salvador allegedly prevented Alfredo from aiding Susan and only pretended to stab Alfredo to save his own life. Construction workers found the injured Alfredo and summoned police; the police found Susan dead at the scene. Policemen later learned that two men had been arrested for attempting another robbery in front of the CCP complex that same night.
At the trial before the Regional Trial Court of Manila, Branch XLIII, Salvador testified that he accompanied Manosca, followed Manosca when the latter accosted the couple, and that he pulled the man away and tried to prevent further killing by advising Alfredo to play dead; he claimed he did not stab the woman and denied inflicting injuries. Manosca at trial asserted he had been “high on drugs,” a fact the Court found uncorroborated by contemporaneous arrest records or earlier statements. Salvador also reportedly offered, during trial proceedings, to plead guilty to simple robbery (an offer that did not materialize due to the prosecutor’s objection).
By decision dated February 16, 1987 (penned by Judge Bernardo P. Pardo), the RTC convicted both Salvador and Manosca of the special complex crime of robbery with homicide and physical injuries (Article 294, paragraph 1, Revised Penal Code) and imposed reclusion perpetua (in lieu of death under the 1987...(Subscriber-Only)
