On the sworn complaint of fifteen-year-old AAA, two informations for rape were filed against her father, Ricardo O. Rabosa, in the Regional Trial Court (RTC) (Criminal Cases Nos. Q-93-42335 and Q-93-42336). The informations alleged forcible carnal knowledge with use of a fanknife: one incident on the morning of February 14, 1993, and another during the last week of January 1993.

At arraignment, accused pleaded not guilty and the two cases were tried jointly. The complainant testified in detail as to multiple occasions of sexual assaults by her father beginning in 1990, describing the events of the last week of January 1993 and the February 14, 1993 rape: being surprised at the back, pulled into a room, threatened with a fanknife, forced to lie down, having her clothes pulled and her father inserting his penis into her private part; on both occasions the assailant switched off the light and later turned it on. She reported the incidents to police on February 17, 1993.

The RTC, in a decision dated December 29, 1994, convicted Ricardo O. Rabosa in both criminal cases and sentenced him to reclusion perpetua in each, ordered indemnities of P50,000 for the victim in each case, and imposed accessory penalties and costs.
