No. 226486, decided on January 22, 2020 under the 1987 Constitution, the accused-appellant Pitulan was charged in three separate Informations for the complex crime of direct assault with murder of PO1 Aldy Monteroso, direct assault with attempted murder of PO1 Alberto Dionisio, and direct assault with frustrated murder of PO1 Benito De Vera, all occurring on April 20, 2003 in Quezon City. According to prosecution witnesses PO1 De Vera, PO1 Dionisio, and PO3 Cortez, the police in full uniform attempted to stop a suspicious Hyundai van. When Pitulan alone refused orders to alight, PO1 Monteroso opened the van door and was shot three times by the driver, later identified as Pitulan, causing his death. A gun battle ensued, leaving several suspects dead and Pitulan wounded; he was apprehended and found in possession of a .38-caliber revolver. Pitulan testified that he was asleep in the van and never fired a shot. The RCase Digest (G.R. No. 226486)
