The information filed on 13 October 1994 charged accused-appellant Andres Penaflorida (ANDRES) together with two unknown persons with the murder on 5 October 1994 of SPO3 Eusebio Natividad in San Ildefonso, Bulacan. ANDRES pleaded not guilty. The case was tried before the Regional Trial Court (RTC), Branch 19, Malolos, Bulacan (Criminal Case No. 2683-M-94), which found him guilty of murder and sentenced him to reclusion perpetua and to indemnify the heirs of the victim P50,000; the decision was promulgated 12 May 1997 by Judge Renato C. At trial the prosecution presented one eyewitness, Rodolfo de la Cruz (RODOLFO), who testified that at about 4:00 p.m. on 5 October 1994 he saw an owner-type jeep carrying Natividad stopped by three armed men; one of the men shouted in Tagalog, “Natividad katapusan mo na ito,” and the three then simultaneously shot Natividad. RODOLFO said he was about five arm’s length from the scene and could clearly see the assailants’ faces; seven days later he went to the 175th PC Detachment where police presented a man he recognized as one of the assailants, identified by the police as ANDRES, and he executed a sworn statement (Exhibit A/A-1). The prosecution also introduced the victim’s death certificate (Exhibit B).

ANDRES testified in his own behalf, denying knowledge of Natividad or RODOLFO and asserting an alibi: that on 5 October 1994 he was in Marulas, Bulacan assisting his brother Roberto in repairing vehicle chassis and did not leave until 11 October 1994. Roberto corroborated that ANDRES worked with him all day on 5 October and lived with him since December 1993.

The RTC found RODOLFO’s testimony credible, credited his positive identification of ANDRES, and held that the killing was attended by treachery, evident premeditation and abuse of superior strength; it convicted ANDRES of murder.
