Case Digest (G.R. No. L-26153)

Facts:

  • Identity, age, and setting of the alleged offense
    • Veronica Narag was sixteen (16) years old and a fourth year high school student at the Pangasinan National High School.
    • Noel Ortega (accused-appellant) was a neighbor in Barangay Bocboc, Aguilar, Pangasinan.
    • On 29 August 1995 at around four o’clock in the afternoon, Veronica stood in front of People’s Rural Bank at the Poblacion of Lingayen waiting for a ride home to Barangay Bocboc, Aguilar, Pangasinan.
    • Veronica wore her school uniform because she had just come from her classes.
  • Circumstances leading to the ride and the trip to Lingayen Beach
    • A tricycle stopped in front of Veronica.
    • The tricycle was driven by accused-appellant Noel Ortega, and his passengers were Veronica’s classmates Brenda Soriano and Geneses Calabitasan.
    • Brenda and Geneses persuaded Veronica to go with them to Lingayen Beach, supposedly at the instance of accused-appellant.
    • All three rode in Noel’s tricycle and proceeded to Lingayen Beach.
  • Events at the beach shed and consumption of gin
    • They parked just behind the Provincial Capitol where they occupied a shed with coconut leaves for walls.
    • In a span of about thirty (30) minutes, a bottle of San Miguel gin was produced by one of Veronica’s classmates and was consumed by the three girls.
    • Accused-appellant stayed outside and did not drink.
  • Sleep, spacing among the girls, and the moonlight conditions
    • After drinking, the girls became tipsy and tried to sleep off their drowsiness.
    • Brenda and Geneses slept on one (1) concrete bench about one and a half (1-1/2) feet wide.
    • Veronica occupied another bench two and a half (2-1/2) feet wide.
    • Veronica’s bench was about three and a half to four (3-1/2 to 4) meters away from her classmates.
    • Veronica later sensed that Ortega was inching his way to her.
    • She claimed she could see Ortega’s face clearly due to bright moonlight and a street light penetrating through the shed walls.
  • The alleged rape: threats, stripping, penetration, and inability of classmates to assist
    • Veronica alleged that accused-appellant pointed a balisong at the left side of her neck and threatened to kill her if she did not give him what he wanted.
    • Veronica attempted to free herself but could not.
    • While pointing the knife at her neck, accused-appellant removed her shorts and her panties.
    • Accused-appellant inserted his penis into Veronica’s vagina and penetrated her twice that night.
    • Veronica’s loud cries for help were not heard by her classmates because they were asleep.
    • After satisfying his lust, accused-appellant left.
  • Post-assault actions of Veronica and the circumstances of their departure
    • Veronica stayed behind with her classmates who were still asleep.
    • Veronica did not wake them up.
    • The group left the beach together at five forty-five (5:45) the following morning.
    • Veronica kept silent because she allegedly had to keep Noel’s threats on her life.
  • Mother’s testimony on disappearance and belated disclosure; medical examination
    • Conchitina Aquino-Narag (Veronica’s mother) confirmed that Veronica went to school on 29 August 1995 and did not return home that night.
    • Conchitina, her husband, and a brother-in-law searched for Veronica, including calling on classmates’ homes, but found no sign of her.
    • They returned home at around eleven o’clock in the evening.
    • At around six o’clock in the morning of 30 August 1995, Veronica arrived home accompanied by classmates, one of whom explained that Veronica had been invited to a birthday party.
    • Veronica simply kept silent.
    • It was not until November that Conchitina learned through rumors that her daughter was raped by accused-appellant.
    • Conchitina then brought Veronica to a doctor for medical examination.
    • On 25 November 1995, Dr. Fairlin Caras examined Veronica and found she was not pregnant nor had she ever been, but her hymen had old lacerations at one, three, six, and eight o’clock positions that could have possibly been sustained around 25 August 1995.
    • Some lacerations could have been one (1) to two (2) years old.
    • Dr. Caras explained that the lacerations could have been due to sexual intercourse.
  • Accused-appellant’s “sweetheart” defense and his alternative account of the day of the incident
    • Accused-appellant invoked the “sweetheart” defense.
    • He claimed he met Veronica near the church in Barangay Bocboc in April 1994 while driving his tricycle.
    • He claimed that despite being married and neighbors, he courted Veronica and became sweethearts with her, and they went to Lingayen Beach in April 1994 and became sweethearts then and there.
    • He claimed their first sexual encounter occurred on 14 February 1995 at Lingayen Beach behind the Capitol, and that they had sexual encounters several times thereafter.
    • To show he had won Veronica, he claimed Veronica gave him a picture in the beach in April 1994 with an intimate dedication and a handkerchief.
  • Accused-appellant’s version of 29 August 1995 and the typhoon-related alibi
    • Accused-appellant claimed that on 29 August 1995, a typhoon occurred, and he went home early because he had no passenger.
    • He claimed he found Veronica waiting for him in his house.
    • He claimed they left at five o’clock in the afternoon and stayed at the house of Maria Aquino (Veronica’s aunt).
    • He claimed they had a rendezvous there because it was raining hard and nobody was in the house.
    • He claimed they left the following morning and later went their separate ways.
    • He asserted the rape charge was allegedly concocted by Conchitina due to hatred, since his version claimed Veronica’s lover would always stay in his house whenever they quarreled.

Issues:

  • Whether the evidence proved beyond reasonable doubt that accused-appellant raped Veronica
    • Whether the trial court correctly found that the intercourse was attended by force and intimidation.
    • Whether Veronica’s credibility remained intact despite alleged contradictions and inconsistencies in her narration.
  • Whether the alleged rape was sufficiently established despite the “sweetheart” defense and the prosecution’s burden of proof
