Facts:
People of the Philippines v. Catalino Mingming y Discalso, G.R. No. 174195, December 10, 2008, Supreme Court Second Division, Brion, J., writing for the Court.The accused-appellant, Catalino Mingming y Discalso (referred to as "Catalino" or "Taling"), was charged by three Informations (all dated July 6, 1998) with three separate counts of statutory rape in Criminal Cases Nos. C-54195, C-54196 and C-54197. He was arraigned on September 1, 1998, pleaded not guilty, and was tried before the Regional Trial Court (RTC), Branch 128, Caloocan City. On March 22, 2004 the RTC convicted Catalino on all three counts and imposed reclusion perpetua for each, plus awards of civil indemnity, moral and exemplary damages.
The complainant, a ten-year-old girl identified in the record as AAA, lived with relatives in Caloocan and knew Catalino as a neighbor. AAA testified to three episodes of sexual assault: one in May 1998 in a vacant lot behind a Petron station and two on June 29, 1998 (one inside Catalino’s house and another later the same day). Her account included details of being seized, threatened with a kitchen knife, undressed, and having Catalino insert his penis into her vagina. AAA eventually reported the assaults; police investigation and a medico-legal examination by Dr. Llamas disclosed a membranous-type hymen with a deep healed laceration at the 6 o'clock position and the external vaginal orifice admitting the tip of the examiner's smallest finger; the Initial Laboratory Report concluded the subject was in a “non-virgin state physically.”
The prosecution presented testimony from AAA, her mother BBB, barangay officials, a police investigator, and a medico-legal witness, and submitted documentary exhibits including AAA’s birth certificate and the medico-legal report. Catalino denied the charges, advanced denial and alibi defenses (claiming he worked in Sangandaan), alleged irregular motives for the complaints, and testified that he had little interaction with AAA.
On appeal the Court of Appeals (CA) in CA-G.R. CR.-H.C. No. 00149 affirmed the RTC decision with modification, ordering Catalino to serve three successive terms of reclusion perpetua and awarding, for each count, specified sums as civil indemnity and exemplary damages in addition to moral damages. The CA relied principally on AAA’s positive testimony and the medico-legal finding to corroborate sexual intercourse.
