Facts:
In the case titled The People of the Philippines vs. Juan Mendoza y Vicente, decided on August 31, 2011, Juan Mendoza was charged with violating Sections 5 and 11, Article II of Republic Act No. 9165, the Dangerous Drugs Act of 2002. Facts:
- Background and Entrapment Operation
- Senior Police Officer 4 Edelfonso Sison (SPO4 Sison) of Baguio City Police Office’s (BCPO) Drug Enforcement Section (DES) received an information from a long-serving unnamed informant that Juan Mendoza y Vicente (the accused) offered to sell shabu (Methamphetamine Hydrochloride) worth P1,000.00.
- The accused proposed meeting at the stairs of Cresencia Barangay Hall along Bokawkan Road.
- Police Senior Inspector Myles Pascual (PSI Pascual) arranged a buy-bust operation scheduled on April 14, 2005, around 2:30 pm, assembling a team including SPO4 Sison (team leader), Police Officer 2 Edgar Antolin (poseur buyer), and other backup officers.
- At 2:00 pm the buy-bust team reached the area early, and at about 2:50 pm the accused arrived and engaged the informant and the poseur buyer. After the poseur buyer handed the P1,000.00 to the accused, the latter gave two sachets of white crystalline substance.
