Facts:

  • Background and Project Implementation
    • In January 2007, the 12th ASEAN Summit was scheduled in Cebu, Philippines.
    • On January 27, 2006, President Gloria Macapagal Arroyo issued Administrative Order No. 139 designating the Department of Foreign Affairs (DFA) as lead agency for the ASEAN Summit’s preparations, with the Department of Public Works and Highways (DPWH) tasked to implement various infrastructure projects supporting the summit.
    • On June 23, 2006, DFA submitted an Aide Memoire to DPWH Region 7 with a list of proposed projects requiring immediate completion by October 20, 2006, recommending alternative procurement methods.
    • DPWH Region 7 received the Aide Memoire and a Memorandum with a list of approved projects and funding, including decorative lamppost and street lighting installation along ceremonial routes in Mandaue City and Lapu-Lapu City, categorized as road safety projects funded by the Motor Vehicles Users Charge.
    • DPWH Region 7 prepared the Program of Works and Estimates (POWE) and Approved Budget for the Contract (ABC), then procured the supply and installation of decorative lampposts through negotiated procurement, resulting in two contracts: Contract ID No. 06HO0008 and Contract ID No. 06HO0048.
  • Bidding and Contract Award
    • In accordance with negotiated procurement rules, three contractors were drawn from the DPWH registry to submit bids for each contract.
    • For Contract ID No. 06HO0008 (bid opening on August 14, 2006), the bidders were GAMPIK Construction and Development, Inc. (GAMPIK), Cebu Technochem Industries, Inc., and Square Cube Construction.
    • For Contract ID No. 06HO0048 (bid opening on November 28, 2006), the bidders were GAMPIK, Cebu Technochem Industries, Inc., and Fambik Construction and Equipment Co., Inc.

  • Memorandum of Understanding and Contract Execution
    • A Memorandum of Understanding (MOU) dated November 22, 2006, was executed between DPWH Region 7 and GAMPIK authorizing GAMPIK to proceed immediately with Contract ID No. 06HO0048, six days before the scheduled public bidding.
    • Contracts were executed between DPWH Region 7 and GAMPIK, with Gerardo Sison Surla, GAMPIK’s Chairman of the Board, representing the company:
      • Contract ID No. 06HO0008 (executed September 12, 2006) for PHP 24,975,000.00 covering the supply and installation of 300 decorative park lamp assemblies along Mandaue Causeway.
      • Contract ID No. 06HO0048 (executed March 8, 2007) for PHP 35,634,401.25 covering four projects related to supply and installation of various lighting facilities in Lapu-Lapu City.
    • GAMPIK received PHP 21,228,750.00 as 85% payment for work completed under Contract ID No. 06HO0008, but no payment was released for Contract ID No. 06HO0048.
  • Investigation and Filing of Charges
    • On January 9, 2007, the Ombudsman-Visayas (OMB-Visayas) received complaints from people’s organizations alleging overpricing of the lamppost projects, and a letter from Crisologo Saavedra presenting a contract proposal with significantly lower pricing for similar work.
    • The Public Assistance and Corruption Prevention Office (PACPO) of OMB-Visayas conducted a fact-finding investigation and issued a Final Evaluation Report on March 23, 2007, finding the lampposts overpriced and recommending criminal charges for violation of Section 3(e) of Republic Act (R.A.) No. 3019.
    • Two Informations were filed before the Sandiganbayan:
      • SB-08-CRM-0270 involving Contract ID No. 06HO0008, charging accused public officers and Surla for willful and unlawful awarding and payment of the contract in excess of the allowable variance, causing undue injury to the government.
      • SB-12-CRM-0006 involving Contract ID No. 06HO0048, charging accused public officers and Surla for knowingly causing the award through negotiated procurement without legal requirements for valid procurement, also with excess contract price causing undue injury.
  • Sandiganbayan Ruling and Proceedings
    • On September 29, 2020, the Sandiganbayan acquitted all accused in SB-08-CRM-0270 for failure to prove guilt beyond reasonable doubt.
    • In SB-12-CRM-0006, the Sandiganbayan convicted Robert G. Lala, Pureza A. Fernandez, Agustinito P. Hermoso, and Gerardo S. Surla for violation of Section 3(e) of R.A. No. 3019, sentencing them to imprisonment and perpetual disqualification from public office. Several co-accused were acquitted.
