Facts:
On May 31, 2002, an Information was filed in the Regional Trial Court of Manila, Branch 48, charging Jonas Guillen y Atienza with the crime of rape committed on May 20, 2002 in Sampaloc, Manila. The private complainant, aAAAa, was in her room playing cards around midnight when the accused neighbor knocked, entered with a balisong at her neck, turned off the lights, forced her to lie on the floor, removed her clothing and his own, and inserted his penis into her vagina by means of force, violence and intimidation. After the assault, the victim sought help from her sister-in-law and reported the incident to the police, who apprehended Atienza near the crime scene that same night. A medico-legal examination by Dra. Annabelle Soliman at the NBI revealed extragenital injuries, a healed hymenal laceration, and spermatozoa. - On May 20, 2002 at around 12:00 midnight, the victim (aAAAa) was alone in her second‐floor room in Sampaloc, Manila, playing cards. Appellant, her neighbor, forced entry by poking a balisong at her neck, turned off the lights, undressed her, and had forcible carnal knowledge. He then left the scene.
