Facts:
On September 10, 1986,
People of the Philippines filed a complaint for rape involving
Liliosa Gargantilla, a
mental retardate, against
Calixto Raga alias “Calix” and
Leonardo Gerones alias “Nanding or Narding.” The complaint was submitted to the
Municipal Trial Court of Palo, Leyte, and after a preliminary investigation found probable cause, the records were forwarded to the
Office of the Provincial Prosecutor of Leyte, which led to the filing of an Information with the
Regional Trial Court of Leyte charging
Leonardo Gerones and
Calixto Raga with rape. The Information alleged that on or about August 30, 1986, in Palo, Leyte, and within the court’s jurisdiction, the accused acted with deliberate intent and
lewd designs, and by means of
threats and intimidation and with the
use of a deadly weapon provided by Gerones, they dragged and pushed Liliosa to Raga, who had carnal knowledge of her
against her will and consent, while the other assisted. Both accused pleaded not guilty, and the trial court proceeded to trial and rendered a judgment of conviction, sentencing both to
reclusion perpetua and ordering them to indemnify the heirs of the victim in the amount of
P25,000.00. From this conviction, both accused appealed, but only Gerones filed an appellate brief assigning errors, principally that the trial court allegedly erred in finding him guilty and imposing
reclusion perpetua and damages, and in failing to acquit him. In resolving the appeal, the Court upheld the trial court’s credibility findings regarding Liliosa’s testimony, addressed the defense challenges to jurisdiction, competency of the witness, sufficiency and medical consistency of the evidence, and the defenses of alibi offered by both accused.
