Wilfredo testified he saw Ricardo raise a .45 caliber and shoot dela Cruz in the forehead and forearm; Wilfredo was himself shot in the thigh. Dela Cruz underwent surgery, lapsed into coma, and died on March 11, 1999. A medico-legal report by Dr. Winston Tan recorded multiple wounds and concluded death by intracranial hemorrhage due to a gunshot wound; no gunpowder residue was found on the wounds. Police recovered three empty .45 shells at the scene; Wilfredo gave a sworn statement at the hospital.

An Information for murder (Article 248, Revised Penal Code) was filed May 4, 1999, charging Ricardo, Christopher and Andrew with murder by treachery, evident premeditation and use of firearms. A warrant issued May 10, 1999; Ricardo was arrested December 10, 1999, arraigned December 22, 1999, and pleaded not guilty. Ricardo testified to an alibi (working in San Fabian on February 24) and denied the charges; Christopher and Andrew remained at large.

Branch 42, Regional Trial Court, Dagupan City convicted Ricardo on August 30, 2000 of murder qualified by treachery and applied as aggravating circumstance the use of a motor vehicle (motorcycle), sentenced him to death under RA 7659, and ordered indemnities and damages. Ricardo appealed. Because the trial court imposed the death penalty, the case was subject to automatic review by the Supreme Court.
