People of the Philippines charged Arturo Enriquez y De los Reyes in two Informations dated June 4, 2003 filed before Branch 57 of the RTC of Angeles City for violation of Sections 5 and 11, Article II of Republic Act No. 9165. - Sometime in May 2003, SPO2 Edilberto David, SPO2 Ernesto Divina, and SPO1 Saturnino Garung received reports from the barangay office and other citizens about drug-dealing in Porac, Pampanga.

- About four operations were conducted on a weekly basis, which allegedly confirmed that Enriquez was dealing drugs among truck drivers and helpers.
- Test-buy on June 2, 2003
- SPO2 David, with one civilian asset, conducted a test-buy.
- During the test-buy, the asset bought P200.00 worth of shabu.
- The substance was allegedly confirmed by burning it, contrary to standard police procedure.
- Buy-bust operation on June 3, 2003
- SPO2 Divina coordinated with PDEA for their ongoing narcotics operation.
- Chief of Police Ricardo Erese briefed the team at Kababayan Center No. 2, Brgy. Sta. Cruz, Porac, Pampanga.
- SPO2 David was designated as poseur-buyer; SPO2 Divina and SPO1 Garung were back-ups.
- Chief of Police Erese gave SPO2 David one P100-peso bill and five P20-peso bills, marked by placing a small bar on the lower right corner.
- Arrival at the target area and sale
- Around 11:00 a.m., they proceeded to Brgy. Manibaug, Libutad, Porac, Pampanga.
- SPO2 David approached Enriquez, who was allegedly sitting in a sari-sari store.
- SPO2 Divina and SPO1 Garung allegedly hid behind a dump truck parked across the store.
- SPO2 David called Enriquez’s attention by saying “dalawang (2) piso” and handed the marked P200.00.
- Enriquez allegedly took the money, went to the back of the store, and emerged after one to two minutes.
- Enriquez allegedly handed SPO2 David a sachet of shabu.
- SPO2 David allegedly put his hand at the back of his head to signal that the sale had been consummated.
- Apprehension and seizure
- SPO2 Divina and SPO1 Garung approached, introduced themselves as police officers, and conducted a body search.
- The body search allegedly resulted in discovery of a plastic game card containing one big and forty-five (45) small sachets of white crystalline substance.
- SPO2 David prepared the Confiscation Receipt.
- The team allegedly brought Enriquez to the Porac Police Station and prepared papers for filing a case.
- Laboratory examination and chemistry report
- Chemistry Report No. D-219-2003, prepared by P/Insp. Dizon (Police Inspector and Forensic Chemical Officer Divina Mallare Dizon), upon request for laboratory examination submitted by Chief of Police Erese.
- The confiscated sachets tested positive for methylamphetamine hydrochloride.
