Facts:
On 24 July 1997, Cynthia Lea Dapoc, then fourteen (14) years old, went to look for the house of an absentee student to deliver a notice for a teacher, but Henry Balmoja alias Ayat guided her to a vacant grassy area with a factory-like structure. He persuaded her to enter, locked her in an embrace, made her sit on his lap, undressed her, strangled her into silence when she pleaded to stop, and threatened her with harm if she told anyone.Balmoja inserted his penis into Lea’s vagina, after which he released her and warned her not to report him. Lea later informed her teacher, Mrs. Cillo, who accompanied her to the police; a medico-legal examination found fresh lacerations on her hymen and abrasions on her forearm. - Background of the offense
- On 24 July 1997, private complainant Cynthia Lea Dapoc, then fourteen (14) years old, set out to locate the house of an absentee student at the behest of her teacher, Mrs. Cillo, so she could deliver a notice.
- While trying to locate the place, accused-appellant Henry Balmoja alias Ayat pointed Lea toward the direction of Ma. Cristina Village.
- Accused-appellant then volunteered to accompany Lea but led her instead toward San Isidro Village.
- In San Isidro Village, accused-appellant persuaded Lea to enter a vacant grassy area with an adjacent factory-like structure, alleging that a certain lieutenant was tracking him down because of a missing girl.
- Once inside the grassy area, accused-appellant locked Lea in an embrace and made her sit on his lap.
- As Lea struggled, accused-appellant removed her shirt, pants, and panty, leaving her with only her sando.

- Immediate reactions and reporting
- Despite the ordeal, Lea did not reveal the incident to the attendant at the beauty parlor from whom she asked for directions.
- Lea also did not tell relatives at home because she was ashamed.
- Lea decided to divulge the incident to Mrs. Cillo.
- In school, Lea broke down before Mrs. Cillo.
- Mrs. Cillo immediately summoned Lea’s mother to the Guidance Counselor’s Office where Lea’s misfortune was apprised.
- Assisted by her mother, Mrs. Cillo, and another school personnel, Lea went to the police station and filed a complaint identifying accused-appellant as her rapist.
- Medico-legal findings
- Lea underwent a medico-legal examination.
- The examination revealed two (2) abrasions on the posterior aspect of Lea’s right forearm, which could have been caused by a hard, rough, and sharp object.
- The examination also revealed fresh bleeding lacerations on Lea’s hymen at the three (3) o’clock, six (6) o’clock, and eight (8) o’clock positions.
- These lacerations could have been inflicted within twenty-four (24) hours before the examination.
- Defense evidence and its discrediting by the trial court
- Accused-appellant claimed that during the incident he was sleeping in his house in Tumana, Concepcion, Marikina City.
- He further claimed that at 6:30 in the morning he was awakened by his brother-in-law Sonny Dalusong to deliver a swing in Cavite.
- He claimed that he opted to sleep it out because he stayed up late the night before watching a mahjong game.
- He claimed he woke only at 1:30 in the afternoon.
- The RTC did not give credence to these assertions.
- The RTC noted that the defense of alibi could not prosper over Lea’s positive testimony identifying accused-appellant as the rapist.
- Trial court conviction
- The RTC-Br. 272, Marikina City, found accused-appellant guilty of rape.
