Facts:
People of the Philippines v. Annabelle Baculio y Oyao and Floyd Jim Orias y Carvajal, G.R. No. 233802, November 20, 2019, the Supreme Court Second Division, Inting, J., writing for the Court.The respondents-appellants, Annabelle Baculio y Oyao (Baculio) and Floyd Jim Orias y Carvajal (Orias), were charged by Information dated April 3, 2009 with violation of Section 5, Article II (illegal sale of dangerous drugs) of Republic Act No. 9165; Baculio was additionally charged under Section 11, Article II (illegal possession). Both pleaded not guilty. The buy-bust operation that produced the arrests was conducted by Philippine Drug Enforcement Agency (PDEA) operatives on April 1, 2009 in Orias’s house in Bugo, Cagayan de Oro City; a poseur-buyer (IO1 Taghoy) testified he purchased a heat-sealed sachet of shabu for P500.00, and PDEA operatives recovered marked money and other sachets from Baculio and others present.
At trial, prosecution witnesses testified to the buy-bust, marking/inventory of seized sachets, and forensic confirmation of methamphetamine hydrochloride; the defense described a forcible entry, physical abuse by operatives, and denied possession or sale. The Regional Trial Court (Branch 40, Cagayan de Oro City) rendered a Consolidated Judgment dated October 7, 2014: it acquitted Baculio of illegal possession (Crim. Case No. 2009-279) for insufficiency of evidence but convicted both Baculio and Orias of illegal sale (Crim. Case No. 2009-280), sentencing them to life imprisonment and fines, and ordering forfeiture of the sachets.
Baculio and Orias appealed to the Court of Appeals (CA) which, in a Decision dated June 22, 2017 in CA‑G.R. CR‑HC No. 01368‑MIN, affirmed the RTC conviction in toto, finding valid in‑flagrante arrest and an intact chain of custody despite some gaps in witness attendance.
