G.R. No. 261857 - People vs. Cynthia Go Moreno, et al.

Accused-appellants Augustus Caesar L. Moreno and Evangeline D. Manigos, along with Cynthia Go Moreno and other co-accused, were charged with violations of the Anti-Graft and Corrupt Practices Act (Republic Act No. 3019) and the Code of Conduct and Ethical Standards for Public Officials and Employees (RA 6713).
Criminal Case Nos. SB-17-CRM-2397 and SB-17-CRM-2398 involved charges against Manigos and Moreno for violation of Section 3(e) of RA 3019.

Between February and July 2010, and later August to December 2010, the Municipality of Aloguinsan, Cebu procured food supplies from AVG Bakeshop, a sole proprietorship alleged to be owned by Cynthia Go Moreno (wife of Mayor Augustus Moreno).
Allegations included giving unwarranted benefit to AVG Bakeshop by circumventing required public bidding, splitting contracts, and using cash slips with a non-VAT TIN.
Accused-appellants as public officers (Mayor, BAC Chairman and members) acted with manifest partiality, evident bad faith, or gross inexcusable negligence.

The Commission on Audit (COA) conducted an audit for the year ended December 31, 2010, finding irregular transactions amounting to PHP 282,725 involving AVG Bakeshop.
The COA Audit Team confirmed AVG Bakeshop ownership was registered to Cynthia Go Moreno via DTI and BIR records.
Complaints and affidavits were filed before the Office of the Ombudsman (OMB) initiating criminal prosecutions.

Augustus Moreno claimed AVG Bakeshop was sold in 2007 to a municipal employee, Lyn Tojeno, who assumed ownership and business permits, negating pecuniary interest.
Manigos maintained that the procurement mode "shopping" was valid under RA 9184 since purchase orders did not exceed PHP 50,000.
Both accused-appellants asserted proper nomination and approval processes and denial of any partiality or bad faith.

Found accused-appellants guilty beyond reasonable doubt for violations of RA 3019 sections 3(e) and 3(h), citing manifest partiality, bad faith, and undue benefit to AVG Bakeshop.
Sentenced to indeterminate imprisonment and perpetual disqualification from public office.
Cases against co-accused who remained at large were archived.
