Facts:
Normallah A. Pacasum v. People of the Philippines, G.R. No. 180314, April 16, 2009, Supreme Court En Banc, Chico‑Nazario, J., writing for the Court. Petitioner Normallah A. Pacasum, then Regional Secretary of the Department of Tourism, Autonomous Region in Muslim Mindanao (DOT‑ARMM), was charged before the Sandiganbayan on 2 May 2002 with falsification of a public document under Article 171(1) of the Revised Penal Code for allegedly imitating the signature of Laura Y. Pangilan, Supply Officer I of DOT‑ARMM, on petitioner’s Employees Clearance to claim salaries for August and September 2000.At preliminary stages petitioner sought reinvestigation and to file a counter‑affidavit; the Sandiganbayan declined to reopen the preliminary investigation and proceeded to arraignment. During trial the prosecution presented three witnesses: Subaida K. Pangilan (former HR officer who received the Employees Clearance and photocopied it), Laura Y. Pangilan (the alleged victim whose signature was denied), and Rebecca A. Agatep (telegraph operator who testified to telegram transmissions). Documentary evidence included a photocopy of the Employees Clearance and telegrams; the Sandiganbayan admitted these exhibits after finding the prosecution had given reasonable notice to produce the originals.
Petitioner testified denying knowledge of the alleged forgery and claiming she did not need an Employees Clearance under a memorandum by Regional Governor Nur Misuari, while defense witness Atty. Jose I. Lorena stated the memorandum concerned outstanding cash advances and required a COA Credit Notice rather than an Employees Clearance.
