Facts:
Office of the Court Administrator v. Hon. Fernando F. Flor, Jr., A.M. No. RTJ-17-2503, July 28, 2020, the Supreme Court En Banc, Per Curiam. The Office of the Court Administrator (OCA) filed an administrative complaint against Judge Fernando F. Flor, Jr., then Presiding Judge of RTC Branch 28, Bayombong, Nueva Vizcaya, alleging gross ignorance of the law for improperly granting bail in a series of criminal cases involving violations of R.A. No. 9165 (illegal sale/possession of dangerous drugs).The complaint originated from a letter by Atty. Jona Gay Pua‑Mendoza, Clerk of Court of RTC Branch 28, who submitted copies of the challenged orders/resolutions and stenographic transcripts. The OCA identified multiple procedural defects across several docketed criminal cases: in Criminal Case Nos. 6964, 7060, 7348–49 and 7409 the orders granting bail lacked a summary of the prosecution’s evidence; in Criminal Case No. 6998 the judge granted a motion to reduce bail without conducting a hearing or allowing the prosecution to comment; in Criminal Case No. 7091 the reduction was likewise allowed without an adequate hearing; and in Criminal Case No. 7826 (involving a child in conflict with the law) the motion for reconsideration to allow bail was granted without a hearing.
Judge Flor admitted issuing orders without the required summaries and explained one grant in No. 7826 by reference to the accused’s youth and mental capacity and pleaded compassion in light of his planned early retirement. The OCA, after factual inquiry, found Judge Flor guilty of gross ignorance of the law and recommended a fine of P50,000, noting a prior administrative sanction when he issued an arrest warrant despite a conflict (his wife being the private complainant).
