Facts:

No. P-06-2267, January 22, 2008, the Supreme Court First Division, Puno, C.J., writing for the Court.The Office of the Court Administrator (OCA) conducted a judicial and physical inventory of cases in the Regional Trial Court (RTC), Branch 15, Sharif Aguak (Maganoy), Maguindanao. In an OCA Memorandum dated March 24, 2003 the OCA directed then-presiding Judge Ismael G. Bagundang to explain why several criminal and civil cases and motions were not decided within the reglementary period, to immediately decide those matters (including Criminal Cases Nos. 754, 830, 1326; Civil Cases Nos. 241, 446, 459 and MC‑750; and motions in Civil Case No. 294 and Motion to Quash Search Warrant SW‑02), and to take various actions on numerous other inactive or unacted cases listed in the memorandum.
The same OCA memorandum directed Officer‑in‑Charge Umaima L. Silongan, then an Interpreter III designated as OIC Clerk of Court of RTC‑Br.15, to ascertain and report on the status of a long list of cases not presented to the audit team, to explain failure to take action in twenty‑two civil cases, to stop re‑numbering cases raffled from the Cotabato City clerk’s office, and to submit compliance reports within prescribed periods. Judge Bagundang submitted a Compliance dated May 2, 2005 attaching decisions and orders but offered no explanation for delay in deciding the specified matters; OIC Silongan initially failed to comply.
The OCA, by memorandum dated June 1, 2005, recommended a P20,000 fine for Judge Bagundang for gross inefficiency and recommended that OIC Silongan be directed to explain her noncompliance. After Silongan submitted a Compliance on August 30, 2005 (citing heavy caseload, limited staff, assignments following the judge’s retirement, new presiding judge’s assignments, and a pending knee operation), the OCA issued a July 14, 2006 recommendation to fine her P1,000 for negligence.
